1. Preamble

These General Terms and Conditions of Sale (hereinafter the “Terms and Conditions”) apply, without restriction or reservation, to all sales concluded between:

• Nature Niche Market, registered with the Paris Trade and Companies Register under number 985 289 784, whose registered office is located at 4 rue Villaret de Joyeuse - 75017 Paris, France,
  (hereinafter the “Seller”),

and

• Any non-commercial individual (hereinafter the “Customer”) wishing to make a purchase on the website markhor.fr (hereinafter the “Website”).

The purchase of a product on the Website implies full and unconditional acceptance of these Terms and Conditions, accessible at any time on the Website. The Customer acknowledges having read them prior to validating the order and accepts them without reservation.

2. Products

The products offered for sale are those displayed on the Website on the day the Customer consults it, subject to availability. Each product includes a detailed description specifying its essential characteristics.

The photographs and illustrations accompanying the products are non-contractual and shall not engage the Seller’s liability.

3. Orders

3.1. Ordering process

To place an order, the Customer must follow these steps:

• Select products and add them to the cart,
• Validate the cart,
• Create a customer account or log into an existing account,
• Enter delivery and billing information,
• Choose the delivery and payment method,
• Accept these Terms and Conditions,
• Validate and pay for the order.

The Customer will receive an order confirmation email summarizing the essential elements of the order (products ordered, price, delivery address, etc.).

3.2. Refusal or cancellation of an order

Markhor reserves the right to refuse or cancel any order in the event of a dispute with the Customer, non-payment in whole or in part of a previous order, or suspicion of fraud.

3.3. Pre-orders

Some products offered on the Website may be available for pre-order. This option is clearly indicated on the relevant product page, together with an estimated delivery date. Full payment is required at the time of pre-order.

Delivery times are indicative and may be subject to change. In the event of a significant delay, Markhor will inform the Customer by email. Orders containing pre-order products will only be shipped once all items in the order are available. Partial shipments are not possible.

If the Customer requests cancellation before shipment, they may contact customer service for a possible refund under the conditions provided for in Article L216-2 of the French Consumer Code.

4. Prices and payment terms

4.1. Prices

Prices are indicated in euros, including all taxes (VAT included), excluding delivery costs. The Seller reserves the right to modify prices at any time. The applicable price is the one in force at the time the order is validated.

4.2. Payment

Payment is made online by credit card through a secure payment platform. The order is considered final only after full payment has been received.

5. Delivery

Products are delivered to the address indicated by the Customer when placing the order. Delivery times are specified during the ordering process for information purposes only.

In the event of a delivery delay, an information email will be sent to the Customer. If the delay exceeds 30 days, the Customer may cancel the order by registered letter with acknowledgment of receipt and obtain reimbursement of the sums paid.

6. Right of withdrawal

In accordance with Article L221-18 of the French Consumer Code, the Customer has a period of 14 days from receipt of the order to exercise their right of withdrawal without having to justify their decision.

The Customer must notify their decision by means of an unambiguous declaration via the contact form. Products must be returned in their original condition, complete and unused, within 14 days following notification.

In the event of a compliant return, Markhor will proceed with an exchange or store credit within 14 days, depending on the return method chosen by the Customer.

7. Warranties

7.1. Legal warranty of conformity

The products sold benefit from the legal warranty of conformity provided for in Articles L217-3 and following of the French Consumer Code.

7.2. Warranty against hidden defects

They also benefit from the legal warranty against hidden defects provided for in Articles 1641 and following of the French Civil Code.

8. Personal data

The data collected is necessary for order management and customer relations. It is processed in accordance with applicable regulations regarding personal data protection.

The Customer has the right to access, rectify, object to, limit, transfer, and delete their data by contacting: contact@markhor.fr.

9. Liability

Markhor shall not be held liable for failure to perform the contract in the event of force majeure, disruption, or total or partial strikes affecting postal services, carriers, or communications.

Markhor shall not be held liable for any indirect damage, operating loss, loss of profit, loss of opportunity, damage, or costs resulting from the purchase of products.

10. Intellectual property

All elements present on the Website (texts, images, logos, trademarks, etc.) are protected by intellectual property law. Any unauthorized reproduction or use is strictly prohibited.

11. Applicable law – Disputes

These Terms and Conditions are governed by French law. In the event of a dispute, the Customer is invited to first contact Markhor customer service for an amicable resolution.

Failing an amicable agreement, the Customer may use a consumer mediator free of charge or bring the matter before the competent court.
